Fresh Therapy Terms and Conditions
1. Contra Indications to Therapies
The Client(s) should state if they have any medical conditions and if they are pregnant before booking.
Certain therapies on people with the following conditions may be harmful for affected areas or may require prior GP approval before treatment can commence:
Allergies, Low/High Blood Pressure, History of Thrombosis, Heart Problems, Phlebitis, Varicose Veins, Epilepsy, Diabetes, Problems of the Nervous System, Skin Disorders or Infections, Haemophilia, Fever, Pregnancy, Asthma, Viral Infection, Bruising, Swelling, Cuts, Burns, Recent Fractures, Recent Operations, Recent Scar Tissue, Cancer, Undiagnosed Pain or Lumps, Acute Injuries, Circulatory Problems, treatment is also not advisable for anyone who has been consuming large quantities of alcohol.

2. Freelance Therapists
2.1. Freelance Therapists will always act in a professional and respectable manner.
Freelance Therapists are self-sufficient, providing their own equipment for the treatments offered.
2.2. Freelance Therapists are not employees of Fresh Therapy. Each is self-employed or engaged under a contract for services.
2.3. The freelance therapist is entitled to pre-scheduled breaks during the course of the engagement. These may be taken as individual breaks or as an elongated break depending on arrangements with the The Client.
3. The Client
3.1. The Client must ensure that guests arrive on time for their pre-scheduled treatments.
Freelance Therapists will make every effort to accommodate reasonable delays; however, treatments shortened or cancelled due to guest lateness will not result in any refund or compensation.
3.2. The Client may be asked to provide standard tables and chairs and water refreshments.
3.3. The Client will ensure that adequate room is provided as advised by Fresh Therapy for
the freelance therapist to perform their treatments and will ensure that the freelance therapist is warmly welcomed upon their arrival.
3.4. The Client will ensure that all guests have signed appropriate consent documentation prior to receiving treatments at the request of Fresh Therapy.
3.5. The Client will take all reasonable endeavours to ensure that guests limit the intake of alcoholic beverages prior to receiving Treatments. The legal limit for driving is a suitable guideline.
3.6. The Client will ensure that guests arrive on time for their pre-scheduled treatments. The Freelance Therapists will make every effort to accommodate any changes due to lateness but in such an event Fresh Therapy will have no liability for any loss of
treatment time.
4. Fees
4.1. All fees for Pamper Parties, Packages, Corporate Events, and other bookings must be pre-paid in full unless alternative arrangements have been made with a representative of Fresh Therapy. Refunds for cancellations by The Client will be issued according to
the following schedule:
4.1.1. Cancellations made more than [30] days before the event will receive a [50]% refund.
4.1.2. Cancellations made less than [30] days before the event will result in the forfeiture of the full booking fee.
4.2. If Fresh Therapy has to cancel the event then a full refund, including deposits will be given.
5. Travel Expenses
The Client may incur additional expenses if you are more than 30 miles out of our radius. Should this be the case, Fresh Therapy will notify The Client in advance of booking confirmation, of such expenses, so they may be agreed upon, prior to any deposit payment being made.
6. Non-refundable deposits for confirmed bookings
Once a booking has been confirmed with a deposit, the deposit is non-refundable except in cases where Fresh Therapy is unable to fulfil the service.
7. Cancellations
7.1. Substitution Policy for Freelance Therapists If a Freelance Therapist is unable to attend the event due to unforeseen circumstances
(e.g., illness, injury), Fresh Therapy will use all reasonable endeavours to provide a suitable replacement. However, if Fresh Therapy is unable to provide a replacement within a reasonable timeframe, The Client will be entitled to a partial refund
proportional to the services not rendered. Fresh Therapy will not be liable for any additional compensation beyond this refund. Refunds in such cases will be limited to a maximum of 50% of the total booking value.
7.2. Late Cancellations by Freelance Therapists
If a Freelance Therapist cancels within 48 hours of the event and Fresh Therapy is unable to arrange a replacement, Fresh Therapy will provide a refund of up to 50% of the total booking fee. The Client is expected to notify Fresh Therapy immediately if any issues arise on the day of the event to allow sufficient time for remedies.
7.3. Limited Liability in Event of Cancellation
In the event of non-attendance by a Freelance Therapist and Fresh Therapy inability to provide a replacement, Fresh Therapy liability is limited to the refund of the portion of the service not rendered. Fresh Therapy shall not be liable for any additional losses, expenses, or damages incurred by The Client because of the non-attendance, including but not limited to travel or venue-related costs.
8. Limited Liability General
Fresh Therapy shall not be liable to The Client for any loss, injury, damage, expense or delay suffered by The Client or the freelance therapist. This exclusion shall extend (but not be limited) to the consequences of any act or omission (whether wilful, negligent, reckless, dishonest or otherwise) which takes place during the event on the part of the freelance therapist or The Client. The Client acknowledges that Fresh Therapy charges are set on the basis that it has no such liability.
9. Force Majeure
Fresh Therapy shall not be liable for any failure to fulfil its obligations under this agreement if such failure is caused by circumstances beyond its reasonable control, including but not limited to acts of God, pandemics, governmental restrictions, or any other unforeseeable event.
10. Data Protection and Privacy
Fresh Therapy is committed to ensuring that your privacy is protected in accordance with the UK Data Protection Act 2018 and the General Data Protection Regulation (GDPR).
10.1. Data Collection
Fresh Therapy collects personal information from The Client and individuals included in any booking, only for the purpose of providing spa and beauty services. This may include your name, contact details, health information (such as relevant medical
conditions), and payment details.
10.2. Lawful Basis for Processing
The personal data we collect will be processed lawfully, fairly, and transparently in accordance with GDPR principles. Our lawful bases for processing include the necessity for the performance of a contract, compliance with legal obligations, and, where
required, your explicit consent.
10.3. Use of Personal Data
Your personal data will only be used for the purposes for which it was collected, which include:
– Providing spa and beauty services,
– Contacting you about your booking,
– Facilitating payments and invoicing,
– Informing you of other products and services;
– Complying with legal requirements.
10.4. Consent
Where we rely on your consent to process personal data (for example, to send marketing communications), you have the right to withdraw your consent at any time. You can do this by contacting us at the email provided below.
10.5. Data Sharing
Fresh Therapy will not share your personal data with third parties unless it is necessary to provide the service, such as sharing relevant health information with Freelance Therapists, storing your information on third party systems such as accounting software, customer relationship management software, or other systems as required, or required by law. All third parties involved in the processing of your data are required to
handle it confidentially and in accordance with GDPR.
10.6. Data Security
We are committed to ensuring that your information is secure. We have implemented appropriate technical and organisational measures to protect your personal data from unauthorised access, loss, or disclosure.
10.7. Data Retention
Personal data will be retained only for as long as necessary to fulfill the purposes for which it was collected or as required by law. For example, booking details and consent forms will be retained for 6 years following the provision of services for legal and
accounting purposes.
10.8. Your Rights
Under the GDPR, you have the following rights regarding your personal data: 10.8.1. Right of Access: You have the right to request access to the personal data we hold about you.
10.8.2. Right to Rectification: You have the right to request corrections to any inaccurate or incomplete data.
10.8.3. Right to Erasure: You can request the deletion of your personal data in certain circumstances.
10.8.4. Right to Restriction of Processing: You can request that we restrict the processing of your personal data under certain conditions.
10.8.5. Right to Data Portability: You have the right to receive a copy of your data in a structured, commonly used, and machine-readable format.
